View Full Version : now it can be told: my DWI ticket got thrown out.

YES!!!!!

Heres the long story:
I went to a birthday celebration of a couple of friends (both had their bdays the same week), and we gathered at a local PJ whelihan's pub. FRom 8:30PM to 1:30AM, i had 3 draft beers. I was driving by myself, i know i CANT drive loaded, so i didnt drink a lot. Keep this in mind, i drank THREE draft beers.

At about 2AM we left, and as soon as i made the turn not 200 yards from the pub, i was pulled over for what the cop said was a busted right tail light. The cop shines his flashlight in my eye and asks me to get out of the car. He proceeded to give me a field sobriety test. I did the eye test, walk and turn test, and the balance test. The cop himself said i did good on the walk test and the balance test, but he said " the eyes dont lie", and he thinks im a .1. He proceeds to HANDCUFF ME, and puts me in the backseat of his patrol car, and takes me to what he kept referring to as "the box".

He takes me to their precinct, and where i think is the holding cell. No bars, just a bench with handcuffs with chains stuck to the floor. There he processed his paperwork, and prepped the breathalyzer unit. I had to blow in it 3 times. The verdict? .03. The legal limit? .08. NJ Law doesnt consider you drunk til you reach .05.

And i wasnt drunk. I was alert the whole time. FRom the time i got out of the pub, thru teh tests, to "the box". I was sitting upright. i wasnt swaying, i wasnt sleepy-looking. I wasnt slurring my words. And i answered straight any questions he asked. I was looking around while seated (what else is tehre to do?).

But he STILL proceeds to write me up a DWI ticket. On top of that he tickets me for the tail light being out, AND adds a THIRD ticket for RECKLESS DRIVING.

3 tickets. The reckless driving is over $400 in fines, and a 4points on a NJ license (12 points and youre suspended), and your insurance rates go up. DWI is worse - 3 months license suspension, over $1000 in fines, and i have to go to some DWI school.

Anyways, i was cool the whole time, and i really didnt feel panic or tense. I knew i didnt commit any crime. I had 3 drinks (watery!), i was alert, and even the breathalyzer tests prove I WASNT DRUNK. My friends Candie and Steve (one of the birthday celebrants) came and picked me up. I spent the night at their place so they can drive me to get my car back (it was impounded). Thanks guys!

Fast forward to Tuesday yesterday. I got a lawyer to represent me 2 weeks ago, and we sort of "plea bargained" (apparently DWIs cant be plea bargained). Either we hash it out with a long drawn out court trial, or we forward the case to the prosecution with our alternative. Throw out the DWI and the broken tail light, and reduce the reckless driving to careless driving (2 points, $107 fine, insurance premium dont go up). We had a strong case with the .03 test, regardless of what the police officer wrote (and you should read what he wrote! ha ha! ill post it when i get my copy). The judge agreed, and confirmed it with the prosecution, and the gavel came down.

total fine with court fees: $140. (YES!!!!!!)

Ok, so i didnt come out totally free, but the ruling was far better than what i expected. And it took not more than 8 minutes to get it all done!

Reality check i found out: The courts as much as we want to hold it in high regard (as in free from commerce), seems to need money too. ANd the alternative we proposed is suitable enough for them. We HAVE to give them something to chew on. Fine, lets just get it done and over with, im my opinion. Less hurt for me, the better.

Court fines and fees for a reduced violation: $***.
Getting your DWI thrown out with the original reason why you got pulled over: PRICELESS.


SO now im broke broke broke. i think i just overdrawn my checking account too...

Lots of firsts for me: first time i ever got handcuffed (and it wasnt even the kinky kind!!), first time i ever got put in the backseat of a patrol car. First time i ever had to do a breathalyzer test. First time i ever needed to go on trial with a lawyer.

i hope those are the LAST times too.
except maybe the handcuffs. on a BETTER situation. ;) ha ha!

That's still utter bullsh@t in my book....

$140 fine? And you didn't do anything wrong? Was your taillight really broken? I don't see why they couldn't give you a "fix it" ticket for that. :shrug:

Just looks like the state did want to get some cash out of the deal... plus they made you look and feel like a criminal for no good reason. :angry:

the tail light WAS out, but steve and i got that fixed the very next morning. ironic that THAT was the only real violation, and THAT got thrown out.

It seems to be the prevalent case each time a violation "occurs". The cop slaps you with a severe ticket, and when you go to court, before you face the judge, youre presented with an "alternative": reduced violation, no points, higher fees. WAY higher fees. Its revenue they can keep propagating, and people tend to take the easy way out. The original violation means points on the license, higher insurance premiums (NJ is the WORST when it comes to car insurance rates), and you stil pay a hefty fine.

it is utter BS, i fully agree. I should have just had the whole thing thrown out, but it would mean more time away from my job, rescheduled court dates, and possibly more money to pay the lawyer with. And there is still no guarantee all of it will be thrown out. Id rather just get it over with ASAP. Especially with the way the report was drawn and written out, and seeing how the local justice system here works, id rather keep away from law enforcements and any courts as much as possible. To me, i feel like they have some contagious disease, and i have to stay away or i get it too. Im sure theyre not ALL that bad, maybe theyre the exception, but one cant help feel but be repulsed by the reality of it all. Its so twisted and far from what it ideally should be, and what they all stand for.

fkd up system, and we all are caught in it, sad to say.
reality bites. In my case, i dont feel i have to get bitten more than once. Or that the bite doesnt have to last any longer than it should. The further away i can be from it, the better.

I feel your pain mang... and I do understand where you are coming from.

Pretty much from what you said up there is one reason why I am very distrustful of the legal system. Good people who haven't really violated any laws can still get the shaft (don't drop the soap!) and there really isn't a dayuuum thing you can do about it (you gonna pay either way).

There is no justice... only Just us. :2far:

That was totally lame. I'm glad you beat the rediculous ticket. But having to pay anything is just wrong. I guess we're partially at fault... the hatred of raising taxes has brought our government to resort to these silly tactics.

No, the unchcked growth of our government brings our government to using the police as a revenue stream.

What a crock of sh!t redcolours. I wouldn't be dancing around if I were in your shoes. I'd be trying my hardest to legally screw the police out of getting any more revenue.

:stupid:, especially with the first paragraph.

Also, if there were a way to sue the police or otherwise reclaim your money, that would be cool. You were handcuffed and confined for no legal reason. You had to fork out more money than the "fix it ticket." Usually warnings suffice with stuff like taillights. Heck, I bumped a guy in bumper-to-bumper traffic - he was pulling a boat with difficult to see (7' in the air) brakelights that weren't working. He was an old guy with an EXPIRED LICENSE driving a car that was a DEALER car and not even registered in his name, pulling a boat. The guy gets out, approaches me, yelling, etc. I just stood there and looked at the damage to my car (pretty bad). I'm legally at fault, as I hit him and was behind him, but the asshat shouldn't have even been on the fking road with an expired plate and expired LICENSE (2004).

But I, and only I, get a ticket for careless operation.

Sucks.

Well glad you got out of some of it. Sorry you didn't get out of more of it. I haven't had any nasty things happen out in so cal. I drive between the rose bowl and ventura most every day and the worst that happens is the CHP runs up on me when i'm going too fast... (once about 110) and sits on me and then drives bye and gives me the look :| And thats about it. I usually keep it with the flow of traffic, and i always signal so that i can avoid looking dangerous or reckless. I think thats more what cops look for. Everyone speeds, but its the people who dive back and forth and cause hazards that get whacked.

Alright i dont know why i felt the need to share, but i guess to say i haven't noticed anything bad around here is my point. wow, i'll shut up now.

that really sucks dude. do you mind telling me what town you were in NJ? I guess if it's close enough by, I'll avoid doing anything even remotely risky there...
