Price mistake?* Last ditch clearance?* This Maytag 30" freestanding
gas range has a large 5.22 cubic foot capacity oven, four burners, and
electronic controls.* Online only, and it probably won't last long (if at all).* Just click through the Home Depot
link to see the $39 price, instead of $699:* <b>

Won't let me add. They are still showing 39.99 though. I think i'll try and call the local store. :)

Looks like they found their mistake. When you click the item on the HD site, it says item is no longer available. Oh well :)

I called the local store and spoke to some lady. She took myname and number and promised to give me a call back. At most, I lose 10 minutes of my time. If I get the item (which I could actually use), I'd be thrilled.

I got an order through, then got this:

At this time your order has been canceled and no charges will appear on your credit card. If you wish to proceed with your order, please either resubmit the order at www.homedepot.com or call 800-455-3869. We hope to hear from you soon and look forward to serving all your future appliance needs. Again, please contact us at 800-455-3869. Please have your order number (shown below) available when you call. Thank you.

They did not e-mail OR call me. Fine, if it's a mistake then I can understand but then call and apologize for it.

The order seems to have gone through. No rejection notice yet.

I had a TERRIBLE run in with home depot once, so the more I can screw them the better I feel

Well, I called and talked to some limp wrist named Jessy. He said because it's a mistake they aren't honoring it. The local store would have honored it if they had them instock. They even searched the entire local northern michigan for me. I put my order in, and it finally went through. Doubt it'll happen, but if it does, score!

I got the order in on time, but called to make delivery arrangement. Spoke to female rep. at the delivery center, she explained to me that they could not honor the price since it was an error on their website, then she proceeded to guide me thru the discrepancy statement on their website incase of price error and cancel the order.

Isn't there a law against bait and switch or something? Home Depot is AWEFUL.

Yes there is such a law, but this is NOT bait and switch. It is a retailer exercising their right to correct price mistakes. They have been doing this long before the internet was invented (such as in cases where a newspaper ad had an incorrect price). If you look at the bottom of the main Home Depot web page, you will see "Use of this site is subject to certain terms of use which constitute a legal agreement between you and Home Depot U.S.A., Inc." The "Terms of Use" linked from there state:
While our goal is a 100% error-free Site, we do not guarantee that any content is accurate or complete, including price information and product specifications. If we discover price errors, they will be corrected on our systems, and the corrected price will apply to your order. Home Depot reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions (including after an order has been submitted and accepted). So, to put it plainly, you don't have a legal leg to stand on.

You'd have to be REALLY optimistic to expect Home Depot to honor this OBVIOUS website pricing error.

What what some of you do with ordering 2 and 3 of these? Sell them on eBay? Geez.... :2far: (and you wonder why reputable establishments like HD will not honor stuff like this. :heh: )

Actually, "bait and switch" would be for HD to give you a super low price on one item just to get you to come into the store, then when you got there, found that they were "sold out"... so that they offered you a supposed "low deal" on a completely different item (which may or may not have been of equal value to the one you really came in to buy.)

Clearly, as Markel said earlier.. it is not a "bait and switch". It is a "pricing error correction" and well within their legal bounds to do.

Thank you all SO much for your free legal advice!

There were a few other details that are unimportant, such as when I called they offered to sell me that same oven for $729, even though they now have it listed at $699(perhaps another mistake???) And the fact that they charged my credit card. But lucky me, I have a few lawyers around to help me through it!
