Driver's Ed 101: LOOK before backing...

Merry Christmas to me, courtesy of a clueless troglodyte...

Ouch, so sorry to hear. Hope it wasn't a hit and run--the running part upsets me way more than the hitting part. Sad too that it was so close to only being the front panel.

Is this the car that someone gave to you?

If it isn't, you just don't seem like a Cadillac kind of guy.

Hopefully your insurance will cover it without you incurring any cost.

I did that to a little Miata once. When he came out of the convenience store I just handed him the phone with my State Farm rep on the other end and I never heard another word about it. I think he was pretty happy to see me. My wife on the other hand...

Naah, I bought it from a family member. It's essentially a Caprice cop car in a tux, complete with LT1 Chevy power and factory dual cats/exhaust.

I've owned two full size cars, twenty years apart - the Caddy and a '69 Buick Electra 225 four-door hardtop.

The other party is insured, and I'll begin dealing with the situation once I get a copy of the police report.

Nifty, kinda like an INTERCEPTOR!

Sorry about the fender bender. Sucks, especially around Christmas. Someone backed into me, twice, on Halloween. TWICE! On a private driveway, so the police wouldn't come. The guy was driving a full-size pick-up. Backed into my driver's side, collapsing my mirror (as designed, but scraped the paint off) and denting my driver's door. Then he pulled forward, backed up AGAIN, this time hitting my rear wheel well and quarter panel. Several witnesses. I was about 20 feet away at the time. I confronted him, and at first he said it wasn't his fault because HE didn't have a rear-view mirror on HIS passenger's side. WTF kind of an excuse is that?

So his insurance company has been jerking me around for a couple of months, saying they can't contact him, he's not answering his phone, etc. I finally calmly and politely advised them that I would have my own as well as my insurance company's legal counsel contact them. The insurance guy said, "can I call you back in 15 min?" Sure. Yep, 15 minutes later he called saying it was all straightened out and that they would pay.

I refused a quick check. Gotta get an estimate on the damage, probably from the same small body shop that I've used before, good people. Then I'm going to demand everything, the rental car, etc. Driving around for 2 months with a wrecked car because of an idiot and a dodgy insurance company just pisses me off. And for the record, the guy's insurance company was Imperial.

Sorry for venting. Just needed to get it out of my system.

And I hope your process goes smoother than mine. :)

Isn't there a fine for not having insurance in your State?

Probably, but it won't fix my car...

Hell, Alabama didn't require auto liability insurance until 2000...

Do you have uninsured motorist coverage? That bites.

Check with the cops too, because she need to be issued a ticket for not having insurance (they do it here in IL and MO)

Aside from that, maybe she'll pay you for the repairs? I know you probably have uninsured motorist insurance, but you're still out the deductible. At that point, you'd have to sue in small claims to get that back if she's not willing to make some type of payment arrangement.

Sorry to hear about the predicament.

big SUXOR doode

Did the other driver stick around and take responsibility of her own accord, or were you right there to make sure it happened that way? (i.e. did she have the opportunity to run but chose not to?)

Caddy dealer says $2400 damage. I will be in contact with the perp in the next day or so to find out if I have to go legal (though I probably will...)

From the Code of Alabama, 1975:

32-7A-15. A person is guilty of a Class C felony who, with fraudulent intent:

(1) Alters, forges or counterfeits an insurance card to make it appear valid.

(2) Makes, sells or otherwise makes available an invalid or counterfeit insurance card, or other evidence of insurance.

A Class C felony is punishable by not more than ten (10) years or less than one (1) year and one (1) day in prison.

Yeah, but if the cops didn't give her a ticket for it you can't.

Did you talk to the cops about having them write her a ticket for it?

I am due to collect from her parents on the 26th, according to her mother.

If this does not happen, then we can "get legal".

At least they're (seemingly) stepping up to the plate.

Hope it all works out for you.
