Interesting California case has ruled that unless a user explicitly accepts a license agreement (such as by clicking "accept") then it is not binding.

This applies to downloaded software and not purchased software.

I thought, Usually you can't d/l them unless you agree to the license

In the case at hand (involving Netscape) they arranged the download differently and you didn't have to agree first

That appears to be one of the reasons they lost
