Hello Apex brothers and sisters,
Since most of you had to deal with that staples mess I figure most of you learned a two or thing about credit card rights. Well I bought something online using my Discover card that I now realize I dont want. The pacakge is unopened and everything normally would be fine, except the place I bought it says that all sales are final so pretty much 'haha I screwed you.' I didnt learn about the 'all sales are final' until after I made the purchase and emailed the guy this morning saying that I wanted to send the package back- Is there any way I can use my credit card rights to muscle the package back to him and get my money back? (It was quite a bit- about $150) I looked on discover cards site, but they dont have any useful information online. . .

I know I know, I should have used that Blue or Visa card with the online buying protection so that if an online store wont take something back the credit company will force them to take it back, but I didn't I used my discover card- and I need your help.

Shouldn't be a problem. I've disputed things like this all the time. What you do is

1. send the thing back to the guy and make sure that you get a return reciept (so you can prove he recieved it), immediately after you send it
2. call discover and tell them that the guy refuses to refund your money even though you sent it back. They will put the charge on "hold" and you will not be charged interest.
3. You will recieve a dispute form in the mail (a few days later). Include your invoice, a letter explaining how the guy "mislead" you and include the proof that he recieved the package. If for some reason he rejects the package you may still be entitled to your refund. Just send the reciept for the shipment cost back to the guy. Don't write "return" on the box or anything, you don't want to set him off that it's a return. You want him to sign for it.
4. I've NEVER had a dispute denied with any card I've used (Discover included) as long as I explain how I was "mislead" and abused by the seller and provide documentation.

Whatever you do ACT FAST. If you wait it puts your story in question.

And if he doesnt accept it, it will get shipped back to me- right? (assuming I put a return address on it.) I just checked the web page and no where on the web page does it say 'all sales are final' either so I guess that really adds to my claim.

Also I call Discover just after I <span style="color:red;">ship</span> it- or after I get the reciept that he <span style="color:red;">recieved</span> it. How does that all work?

This is what you should do. Call up your credit card company and tell them that you would like to dispute that specific charge, b/c the merchant you dealt with is refusing to accept a return. Simple as that. You've done all you can as a customer to try to return it in good faith. Most of the time, you have to wait until you receive your statement. Works with both my Amex cards and my Visa. Hope Discover treats you well. Good luck. DON'T ship it back yet.

Discover is very good about things like this. I had to call them up because of staples before. They adjusted the price so staples could only charge me the price with the coupon.

You can do it before or after you send it back. It doesn't matter. You're not going to have a problem. Just call them. If you do send it back just save the reciept so you can prove you sent it back.

Bottom line: You won't have a problem.
