Army Refuses Resignation of Soldier Who Says He Is Bisexual

FORT BRAGG, N.C. — The Army has refused the resignation of a Fort Bragg soldier who says he is bisexual, saying there is not enough evidence to support his claim.

Capt. David Donovan's supporters say the refusal violates the Army's "Don't Ask, Don't Tell" policy, but Army spokeswoman Martha Rudd denied violating the policy and said soldiers who make admissions of homosexuality may be required to provide proof.

"If there is reason to doubt the credibility of the admission, the request to separate from the service may be denied," she said.

Donovan's statement that he is bisexual should be enough for his discharge, said the Washington, D.C.-based Servicemembers Legal Defense Network, a group that fights for the rights of homosexual service members.

The Army regulation governing homosexual conduct says that "credible information exists" for discharge when a soldier says "that he or she is a homosexual or bisexual."

Donovan has made four requests to resign, beginning in September 2000. But he said he has been reluctant to provide details of his homosexual conduct for fear of incriminating himself.

Homosexual conduct is a criminal offense under military law.

Donovan said he has provided the military with letters from a licensed psychologist and a close friend supporting his claim.

Fort Bragg officials, including Lt. Gen. Dan. K. McNeill, said Donovan should be discharged under "other than honorable" conditions and have to repay the Army for his college education.

The Army said Thursday that the denial of Donovan's request was not a reversal of the "Don't Ask, Don't Tell" policy.

"The policy has not changed," Rudd said. "The Army Review Board Agency did not have sufficient information to support Capt. Donovan's admission. The Board could reconsider the request if sufficient information were provided."

Donovan could retire in three years with a military pension. He has agreed to pay back his college money if the military accepts his resignation. He would also give up his veteran's health benefits.

um...correct me if i'm wrong here...but he had his shrink give a statement...so how much more proof does he need? do they want sexual favors? a porno? what?!?

I hate people who use the military for financial gain and then leave when the going gets tough. :mad:

I hate people who use the military for financial gain and then leave when the going gets tough. :mad: actually, he's a captain. there's a good chance he's already seen action. plus he's at fort bragg...i don't think he's overseas or gonna go. he's giving up his pension and wants to repay his tuition. he's been trying to get out since sept of 2000. i don't see this as trying to avoid the current conflict.

he's trying to get out without putting himself in jail.... i can understand that. I think they should let him off honourably, actually... but then again, i don't know politics well enough.
