Okay, this is my problem. I've had cingular for a year now in april and technically i quilify to upgrade my phone. I hate the current phone i have, but my service hasn't caused me any troubles and i'm happy with it so changing the phone company is not an option.

So i want to trade my phone so i went in to trade it and they said i couldn't trade it in till august. So i was a bit shocked to find out i couldn't upgrade my phone. Well in august i upgraded my plan so i guess taht reset my year of service. so whatever.

I took my dad's phone in which he also got in april and the guy said it was fine to upgrade, but i would need to buy a 2 year warrenty ($70) and that was mandatory to upgrade, so i said forget it, cause i knew he was just trying to get a little commission off the warrenty and no other place that my friends upgraded their phone did they need to pay for it.

So i took it to a third cingular place to try and upgrade it again. This time i needed to extend the service for another 2 years if i wanted to upgrade the phone. No warrenty this time, jsut 2 more years of extar service.

So 3 cingular places, 3 different stories and i'm just tired of it. Can someone help me out maybe and tell me how i can get a phone? cause i hate the current phone i have. If someone lives in the bay area (closer to San Jose the better) can you hook me up with a phone or something?

i think you should call Cingular's corporate office or CS and tell them about this bull**** and tell them that you're tired of it. they should hook you up with something free for this kind fo run-around. oh, BTW, don't tell them you're happy with your service until they give you something free. who knows what you'll get...

i think the best way to figure this out is call up 611, not deal with the middlemen (cingular stores). however, remember that even 611 representatives all give different answers to the same question. after dealing with cingular for one and a half years, i've concluded that the cingular representatives are actually given a LOT of power of what they feel like giving you. in my last few bouts with cingular, about 5 different representatives gave me 5 different stories. i kept on calling them back until the person i talked to gave me a good deal.

in addition, the last time i remembered it, upgrading your plan does not renew your contract, but downgrading it does. unless the rules have changed, the first store gave you false information. if you're in a store, and something sketchy comes up, tell them to pull out the contract and show you on paper. NEVER take their word for it. a lot of cingular reps can be real dirty.

lastly, even though you might be happy with your service, don't tell them that (just like brewmaster said). not only that, but you should threaten to change service providers. last time i talked to one of the cingular representatives in early january, the rep admitted to me that there were a lot of people who dumped cingular when their contract was up and changed to other providers, so the reps were allowed to do whatever they could to try and keep their customers. try to use that to your advantage.

in the end, i guess the more persistent and patient you are, the better the deal you'll end up with. play the role and put on the tone of "mr. businessman who's not gonna let cingular screw me over" and i'm sure you'll end up with something you'll be satisfied with.

if u just want 2 upgrade your phone...why not just buy one? like off ebay or the stores or your friends? cingular doesn't have 2 know a daym thing either. all u gotta do is take out your lil chip and put it into the new phone.

i upgraded my phone when my yearly contract was over. bought something on eBay, replaced the chip, and everything is good to go.

that crap about the warranty or fees or wutever...its all a scam to get your $$. well..good luck!
