Actually, you don't even have to officially register a trademark. You can just slap a TM symbol on something that you KNOW FOR SURE that no one else is using - and as long as you have proof that you trademarked it at a certain point (by notary public, etc), you can be fairly confident that your trademark is safe.

However, registering it allows you official proof and absolute confidence.
