Man, this is jacked. Apparently this guy was the winning bidder of an EVO on eBay and at the end of the auction the dealership refused to sell it to him at the final price of $26200. Just spreading the word..

I was the legimate winner of an ebay auction last night (http://cgi.ebay.com/ebaymotors/ws/eBayISAPI.dll?ViewItem&item=2438028950) for a Evo. I've been in the market for a STi or an Evo. Each has their strengths and weaknesses. A primary attraction for this car was the final $26200 e-bay price for an untitiled car.

Josh Jones at Mark Mitsubishi in Scottsdale AZ emailed me after the auction had ended and informed me that the car had been sold to an autobroker for a greater amount. The auction did not end early and was not cancelled.

it does say this on the end of the auction

i don;t know what ebay will do about it, prob nothing. this sucks.

funny thing is how this has spread to dozens of forums across the internet in like a day. read the thread; the calls people from all different forums are giving this dealership & corporate are funny :p

I disagree. The working talks about cancelling the auction. Well, the auction was over. You cannot stop something that has already ended. Besides, Ebay does have rules that must be adhered to regardless of what fine print you put on your auction.

I'd sue them if it was me. An ebay auction is a legal contract for both the buyer and the seller. He will prolly end up getting that car for that price minus lawyer fees.

Indeed -- as was stated in the original forum, if Mark Mitsubishi had no intent of selling the car for that price, he should have set a reserve. The fact that he didn't, and waited nearly THREE hours AFTER the auction to send a reply e-mail that the car was sold makes it sound deliberate.

eactly. basically, he could either sue them for specific performance of the contract (difficult since they already sold the car) or he could buy another car and then sue them for the difference. i'm not sure exactly how eBay's terms and conditions work, but i don't think sellers can cancel an auction after it has closed if there was no reserve price (or if the reserve price has been met).
