She's at it again...She went and filed a claim with the Fraud dept. at the bank and they took my money and gave it to her...Because she called them and told her that she didn't know how I obtained her pin # to her account they have a legal obligation to the person filling the claim to give them that moneies back. I will have to add that to the countersuit but it's still a pain in the arse.
Lesson of the day: Never under any circumstances have a joint checking account with anyone!
*sigh*
Sorry to hear this is happening to you. Hope things turn out for the better after the legal battle.

I work at a bank and unless the person who's name is on the account gives their permission to even access the funds or ANY information in the account, the bank is held liable and can get in ALOT of trouble for that.
Ex. I have an account that is a joint savings account thru my work for Dopey's son I'm on the account a little dopey is. Dopey or his stupid ex or anyone can not have any access to that account. If they do get any information or anything, even the balance, I can sue the bank for privacy violation, I forget the exact code about it, I have it at work ( i'm at home today w/ a sore throat ), I can get it for you if you'd like. By law the bank can't even answer if you have an account with them if the person asking is not on the account.
And yeah, I'm happy with my money in my own account, I think if I were to get married and have a joint account, I would just keep my own account, and have a very minimum amount go in to the joint for whatever I needed it to be there for.

This seems to be a new-ish trend. I remember growing up (I'm 24) it was far more unheard of to not just have a joint account. Of course, that was also a time when you didn't get divorced 50% of the time. If you can't trust a person with your money, should you really marry them?
Pinkgirl36 - that is absolutely correct what you just said. At my previous employer I was helping track some sales and sometimes tried to contact the bank to see if a company's check had cleared on their end (there were a lot of NSF checks coming through my company). I would say 75% of the time, the reps would turn me down saying that I was not authorized to receive such information. Even with the check number and the exact amount, they refused to tell me if the check had cleared the bank or not.
Chicken_Hawk's problem is that his name and his Ex's name were on the joint account. So, legally speaking, she can take whatever was in that account. However, if i recall correctly, Chicken_Hawk had moved the money from the joint account to his personal account where he was the only signer. Then his Ex talked the bank into moving the money from his personal account, back to the joint account, so she could take the money. That, is illegal. Somebody at the bank opened up a can of worms and I'm guessing that it costs them their job(s).

But I do like to have my own money regardless, because if I want to buy something for my SO and don't want them to know about it, if it were for them or something, it would be easier to hide it, but yeah, I have a JT saving account w/ Dopey, it's all my money in there, I trust him with it...

Mrs. Kevster and I have joint checking/savings accounts and I have a single checking account with my company's credit union. I divert a small amount of money from my paycheck into that account every week to cover my cash expenses (I withdraw that amount every week). I like it because it keeps our joint account relatively stable and keeps me to a fixed weekly budget for my discretionary cash purposes (lunch, fish/turtle supplies, G|A deals, misc. groceries, etc.).

Well I talked to the bank and they told me according to a federal law they person that creates the claim with the bank has the right to the money because they assume it's fraud.
Long story but My money came in direct deposit to a joint account, she then transfered the money to her own account. I then go home and transfer most of the money from her personal account back to the joint account and on a different day transfer the rest to my personal account. 2 days later she goes into the bank a claims that I illegally took her money from her account and the bank takes my money from my account and puts it into hers and she closes her personal account. I then go raise holy hell at the bank and filed a report with the police and the bank for fraud charges. Obviously the bank reverse the transfer and gave me my money back. She went down to the bank and claims that I made a unauthorized web transfer for the later amount and because it was transfered from her personal account to my personal account the bank has to honor her claim because of the law. Very pissie with the bank and just general upset at the world today.

dude, get your money and run, go to another bank (if you can).
when i get married, ill have a joint account, but share very little. not only for the unusual untrustworthy cases (like someone posted: why marry if you can't trust them?), but i don't want her to make a dumb decision and spend my money, and vice versa.
