View Full Version : Fighting a Speeding ticket by mail

I was driving up on the 5 freeway and I received a speeding ticket for going 92mph on a 65 zone. My speedometer read 75(but the actual speed might be around 80 because I have bigger wheels than stock). So I do admit that I am partly guilty. Can I still plead not guilty and request a trial by written declaration? If so, does anyone have a sample letter I could look at? I'd appreciate your suggestions. Thanks

good luck...ive tried by writing to them, but they wont make any changes...your only chance is to show up at court on the date at the bottom and hope to god that your cop doesnt show up.
then youre free!

5 Freeway, CHP? They will show up. Was there someone else on the road going faster than you? Was it POP radar? Radar is traditionaly very very accurate.

I was hoping to do a trial by writing because i cant goto court. It's 5 hours away from me..its in Lamont,CA

wow you're screwed. i've never heard of it being possible other than showing up on the court date. :shrug: weird that you got pulled over up on the 5. we've normally had good luck up there, we were doing about 85 once and a cop just drove right past us... weird. i guess 92 might be pushing it tho

Hehehe i was going 100+ and mr chippie didnt show up. My good luck came when the courthouse in his jurisdiction closed for remodeling, and he had to drive an extra hour, guess he got lazy.
Just pay the damn ticket, request traffic school, GIVE UP!! If you have time to drive up there a couple times (not to mention $80 of gas)then go for it.

What you can do the next time you get pulled over is before the officer writes the ticket, tell him you would like the court location to be at the county seat. For instance, if you're on your way to Vegas near the Nevada border, you probably won't want to drive out to the nearest courthouse out there to settle up your ticket. Being that San Bernardino county is huge and covers all of the area up to the Nevada border, having your appearance at the county seat (San Bernardino) would do two things for you. 1) you don't have to drive to BFE to fight your ticket, and 2) there's a decent chance the cop lives in the area he patrols, and probably wouldn't want to drive to San Bernardino to make a court appearance.

I don't think this advice would have done edmiceter any good since he lives outside of the county, but it might help someone in the future.

No he won't. By California law he is guaranteed a Trial by Written Declaration. This applies to all traffic violations.The benefit of a TbWD is that if he does not like the verdict he can then request an in-person trial. Check my link out. It is totally legit, yet is never advertised. These institutions would rather have you send them your money than put up a fight.

Hey verve, you don't have any contact info besides PM listed in your prof and I didn't get a response from you via that method. Just got my second ticket within 18 months and I was curious as to whether you successfully fought yours with help from that attorney guy.

My girlfriend got out of a speeding ticket with radar because she questioned how long it had been since the radar unit had been serviced. No one showed up with the info and the judge tossed it.

As others have mentioned, your chances of CHP not showing up to a traffic case are very unlikely. Best bet is to fight it by written declaration.

Check out www.ticketassassin.com - I've been 3 & 0 with their advice so far.

A week before it's due, mail in the ticket/bail to fight it. That way you only have to go up there once. Show up for the court date. 50/50 and you can take traffic school if he shows.

Ticketed by CHP in OC? You're chances of losing a trial by dec is pretty great. I just tried to fight a 84mph ticket I got on the 5 with ticketassassin forms and lost. The cop will most likely show up in court too since writing tickets is what CHP does best. Another thing about OC is that if you live out of county, you can't do online traffic school. Brick and mortar only.
