my wife's uncle started a band called "Risky Business" will there be any copyright violations using that name because there is a movie with the same name?

Yes. If the company that owns the movie decides they want to enforce it they can step on them bigtime.

Yeah, I would think so too. There was a band called Green Jello, but Jello had a complete hissy fit, and sued them. So they had to change thier name to Green Jelly.

Yeah, I think there's an argument to be made legally. I say that they go ahead and do it until they get sued, and if then, go the route of Save Ferris and choose a name that's referential to Risky Business, but not Risky Business itself.

They should be fine as there is no reasonable way for one to be mistaked for the other.
As for the green Jello reference above...Jello is a trademark and that makes a difference.

How about this one... Later this summer I'm leaving my day job to start a video production business. I seriously want to call it "Famous Davis Productions" but I'm afraid I'll run into problems with the Famous Dave's restaurant chain. Am I begging for a fight?

Seems like they are both in different lines of business and the names are different. I doubt a reasonable person would confuse the two - especially if you have different trade dress (company logos and colors)
