It's not just coffee folks, even pizza toppings can be hot!

http://www.mcall.com/sns-othernews-1128burnedchin,0,7003208.story

A woman is suing the Pizza Hut in Lehighton, Pa., because the hot poppers she ordered as an appetizer were, well, hot and popped when she bit into them.

Sorana Georgescu-Hassanin claims she may be permanently impaired because the ''excessively hot'' oil in the deep-fried, cheese-stuffed hot pepper severely burned her chin.

Her husband, Hatem Hassanin, is suing for the loss of companionship and comfort of his wife.

Well, if I was deciding the case I would rule in favor of the plaintif, but only award an ice cube and a napkin. They would, of course, be responsible for their own legal costs.

A stupid law suit deserves a stupid payout.

"Mrs. Hassanin, this court finds you stupid. You are hereby sentenced to carry an 'I'm stupid' sign with you were ever you go, to be promenently displayed at all times. This is for your own protection and the protection of those around you."

Who told you to put the balm on? I didn't tell you to put a balm on. Let the doctor put a balm on.
Well I didn't think it would work.
Do you know what a balm is? Have you ever seen a balm? Do you know what it's capable of?
Well I guess I screwed up.
</seinfeld>

Maybe she'll settle with Pizza Hut for a free year of pepper poppers. :heh:

But this had nothing to do with pizza.... :heh:

This had to do with Poppers... (which are cheese filled jalepeno peppers.)

so if the case is thrown out does each party have to pay their own legal fees?

Depends on state laws and the judges ruling. The judge can throw it out and require the plantif to pay the legal fees of the defendant in some cases I believe. But usualy, the defendant is stuck.

If you didn't read the link, then you missed this part:

The suit names the Dallas corporation and Richard Whitson, who owns the Lehighton franchise and his company, QSM, LLC. It says they failed to warn Sorana Georgescu-Hassanin the appetizers were hot and neglected to drain the oil from them.

Whitson declined to comment, other than to say, ''The incident took place before I owned the store.'' He bought the franchise in April.

Whitson probably didn't realize the low price he got on the franchise wasn't such a bargain.

I like this ruling. I think she should also be forced to pay *all* legal and court costs. Idiots!!!!!

Sounds like she is suing the wrong person than.

Sounds like she is suing the wrong person than.

Depends on what you would categorize wrong.

If the previous owner went bankrupt, than she's suing the "richer" person.

How exactly can one become permanantly impaired from hot grease? I seriously doubt it was hot enough to cause third degree burns requiring skin grafts from her ass.

I mean come on... :disa:

Fixing some laws to protect a business without giving them too much protection that they are shielded from wrongdoing :) Basically the system that is in place just says that each case will be decided by the courts and our faith is in the judge/jury to make the correct decision if whatever the business is accused of doing was wrong or not.

We have a system in place and most people that do win what people think would be "frivolous lawsuits" won because of some other neglect that it was felt the company was actually wrong in doing.

Even the Mcdonalds Hot Coffee case had a bit of merit when you find out that the coffee they were keeping on hand was hotter than it needed to be to be "Hot Coffee" when you got it. And she only really won about 200k not over 1 million.

But anyways, I think that the system in place probably works atleast 90-95% of the time, if not more.

A Person sueing is different than a person winning a frivolous case.

Very true. Only 1 minor point:

Coffee should ideally be 196 to 204 degrees F (some round to 195 to 205 degrees F) for optimum taste. Macdonalds kept their coffee at a lower 180-190 degrees F. The lawsuit called for 135-140 degrees F as more consumer friendly.
