KANSAS CITY, Kan. - Most of the time, 16-year-old Zach Rubio converses in clear, unaccented American teen-speak, a form of English in which the three most common words are "like," "whatever" and "totally." But Zach is also fluent in his dad's native language, Spanish -- and that's what got him suspended from school.

"It was, like, totally not in the classroom," the high school junior said, recalling the infraction. "We were in the, like, hall or whatever, on restroom break. This kid I know, he's like, 'Me prestas un dolar?' ['Will you lend me a dollar?'] Well, he asked in Spanish; it just seemed natural to answer that way. So I'm like, 'No problema.' "

But that conversation turned out to be a big problem for the staff at the Endeavor Alternative School, a small public high school in an ethnically mixed blue-collar neighborhood. A teacher who overheard the two boys sent Zach to the office, where Principal Jennifer Watts ordered him to call his father and leave the school.
Watts, whom students describe as a disciplinarian, said she can't discuss the case. But in a written "discipline referral" explaining her decision to suspend Zach for 1 1/2 days, she noted: "This is not the first time we have [asked] Zach and others to not speak Spanish at school."

Since then, the suspension of Zach Rubio has become the talk of the town in both English and Spanish newspapers and radio shows. The school district has officially rescinded his punishment and said that speaking a foreign language is not grounds for suspension. Meanwhile, the Rubio family has retained a lawyer, who says a civil rights lawsuit may be in the offing.

California Gov. Arnold Schwarzenegger (R) made that point this summer when he vetoed a bill authorizing various academic subjects to be tested in Spanish in the state's public schools. "As an immigrant," the Austrian-born governor said, "I know the importance of mastering English as quickly and as comprehensively as possible."

what i find so stupid is that he wasn't speaking spanish in a class .....he was having a short "conversation" (if you can call it that) w/another student in the hallway when a teacher overheard him talking in spanish

good point. i can understand it's not cool in sports or other competitions where it could be used to cheat, and it's not cool in class (b/c you're not supposed to be talking anyway)

but what. a load. of crap. i hope bad things happen to the people who did this. like hours and hours of mind-numbing sensitivity training!

I don't support rampant filing of lawsuits, but I think that one is perfectly in order in this case.

To follow on with my previous statement, does the principal of the school outlaw students from practicing any foreign language that they are taking outside of the actual classroom?

That principal should be canned.

That is total f*cking BS. First of all - wouldn't he be expected to be practising his Spanish in school if he was taking it, and not bilingual? We would walk down the halls of school in Texas hearing EVERY language (Vietnamese was not uncommon, French - because of the Vietnamese, Spanish obviously) and these students were great in helping tutor you for your foreign language requirements. To suspend a student who speaks his native tongue beyond a classroom clearly because the principal was ignorant is.... oh, man. I have to get some fresh air I am so mad. Then write a letter to that district.

"No problema" isn't even entirely Spanish. The phrase is used commonly in English here in California.

That in and of itself is unreasonable. I can see requiring him to speak only english in class, some students might use a foriegn language to disrpt a class. But outside of class, talking to another spanish speaking student?!? That's unreasonable. Unless all the students are forbidden from speaking their native tounge in on school grounds (as was done to the Native Americans in an effort to destroy their culture) then the spanish speakers must be allowed to speak Spanish, so long as it is not detracting from anyone's education.
Furthermore, it's only pollite to respond in the language in which you are addressed if you are able.

And as I said earlier, the case could be argued that he wasn't speaking Spanish. He was using an English phrase derived from Spanish. Like "deja vu" is used in english, but it is originaly French. Try speaking English without using any Spanish.

I dont understand the logic behind that!! My soon to be sister-in-law was telling me she's a little bit hesitant about teaching her kids spanish (my families hispanic) coz they might speak about her in spanish! Now, we all find a way to talk smack about anyone in any language!!

I really hope they fire that principal!!:johnwoo2:

Was he thinking coz he was speaking a foreign language that the kid was planning a terrorist plot????!!!! Ridiculo!
