GARDEN GROVE – A co-worker of seven lotto winners is suing to get a share of the group's $316 million jackpot, alleging he was part of the "pool" that usually buys tickets together.

Jonathan P. De La Cruz, a medical lab technician at Kaiser Permanente Medical Center in Garden Grove, seeks $39 million in damages, according to the lawsuit filed last month in Orange County Superior Court.

Seven of Cruz's co-workers -- called "Lucky 7" -- won the Mega Millions jackpot last month. It is one of the largest lotto winnings in the nation. Each winner will receive $25 million before taxes.

Mariza Cuya, Bob Guerzon, Jennifer Habib, Brenda Heller, Kathy Jones, Kate Lynn Juergens and Joyce Onori each put in $3 into the pool.

Cruz contends he had "an oral agreement" since 2001 in which he agreed to pay into a pool to regularly purchase lotto tickets, the lawsuit says. He also alleges his co-workers broke this agreement by not giving his name when claiming the winnings from California State Lottery.

Joyce Onori, 60, of Santa Ana disputed Cruz's claims, saying there was no organized pool. When the winnings were big, Onori said co-workers would randomly ask around who would want to play. Cruz would sometimes chip in, she added.

Onori said Cruz gave her a big hug and said congratulations the day she found out about the winnings. She said she and the other "Lucky 7" employees were shocked when they found out about the lawsuit.

They banded together to hire a lawyer.

"We feel awful, it's just terrible. He was like a son to me," said Onori said. "It's just so sad, this is keeping us from going on with our lives."

Cruz and his attorney could not be reached for comment.

The lawsuit has been assigned to Judge John M. Watson

That's his loss. What we do @ work is if someone is not in on that day, we pitch in for that person.

I hate hearing about stuff like this.

Same kind of thing happened in my extended family awhile back... my uncle inherited management/ownership of a company from his father, with his sisters receiving only shares of the company. They opted to sell them because they needed the money. Several years later, my uncle sold the company and the sisters would've received much more money had they waited, so rather than accept their mistake, they sued. Tore the family right apart. Bleh. People should be jailed for lawsuits like that/this.

I learned in b-law oral agreements hold in california. but only for 14 days. PLUS, like bachviet said, it's freaking hard to proove the oral agreement.

I think the only thing resembling a leg he'd have to stand on would be if they purchased $24 of tickets for that drawing. $3/each for seven shares would be $21. If they purchased $24 you could make a reasonable argument that at three bucks a head there were eight shares.

All in all, gotta agree with the sore-ass loser comment.

i saw this on the news as well and one of the winners said that she went around asking people if they wanted to pitch in .....usually they had more people pitching in, sometimes less but they had never agreed upon anything

he's such a dumb ass .....everyone's getting $25k & he's asking for $39k ....WHAT A LOOSER!!

39 is likely what his cut would have been before taxes.

What I am hoping is that they follow through with this on principal and countersue for legal fees/intrest lost because they cannot collect until this resolved. Whiners like this moron need to learn their lesson.

yup, that's what the lady said (interviewed on the news) ....he's only delaying their winnings

So if they had lost all their money would he have still given them the money he would have put in afterward? I think not- therefore he is unentitled to share in the winnings. If you want to play, you have to pay.
