Sounds like he let off the gas at the wrong time - something you can't do with that type of car (dependent on rear wheels for traction and therefore weight shift to the rear under throttle) without your rear end fishtailing. Still, he wasn't legally drunk.
It sounds like he just screwed up while driving. I don't see any merit for a lawsuit. :shrug:
Didn't Kelsey Grammer do the same thing in his Viper a few years ago?

He wasn't leagaly drunk when they tested him an hour after the accident. Assuming a normal weight and metabolisim he was probably about 0.09 to0.10% BAH when the accidnet occured.

yeah this lawsuit sounds completely bogus. drunk or not drunk, this is absolutely ridiculous that a person incorrectly operating a high-risk vehicle is entitled to sue.

Inferring his BAC based on a delayed test isn't necessarily valid and won't stand up in court as a testament to his possible excessive BAC at the time of the accident. At any rate, don't drink and drive. :)
