Well, the seat was down. I don't know why the kids were there..Maybe they get a kick out of it. But if they were forced there, it's another story.
If it was voluntary, the only offense I can see is failure to wear seat belts. And I am unsure if that even applies to people sitting in the back seat.
Also, the hot trunk argument mentioned doesn't apply in the winter in Maryland.

My niece pulled the back of the seat down in my car and got a kick out of hiding in the trunk, but not while I was driving

Yes. If you weigh less than 10 kg then you have to be strapped into a rear facing child seat that is seat belted to a car seat. If you weigh 10-20 kgs then you need to be strapped into a front or rear facing child seat that is seat belted to a car seat. If you weigh more than 20 kgs then you need to be seat belted into a car seat just like an adult... at least that is the law in California (although I'm not positive about the exact weights... +/- a couple of kilograms).

how enforceable is it, tho?
in IL, the law is rear facing til 20-30 lbs, front facing to ... uhhh... maybe 40 lbs? and a booster seat til 80 lbs or something.
problem is, it's completely unenforceable. you can pull someone over for having an unrestrained child, and if they have a carseat in the trunk, they don't get a ticket. i'm not kidding. it's like... uh, i have one i was considering eventually using when i sobered up, ossifer! and the police say, good job, sir, no ticket for you! EG's biological never puts EG in his carseat, so i looked into it... not a damned thing i can do to make him stop it. (though apparently EG took care of things himself recently by planting his butt on the sidewalk and refusing to get in the vehicle until he got a carseat :hihi: )

Good point. Haven't actually asked a cop how enforceable that law is. Next time I see one, I'll make sure to ask him/her. I know we don't let them bring a small kid home unless they show up with a child seat that fits the kid (I've actually held onto a kid because parents were stupid enough to show up with a childseat that is too darn big).
Here in CA ....they give you a very expensive paper ....a ticket for not having your kid in that car seat .....

yeah, the hospitals do that here, too... and on a side note, a 5-1/2 pound preemie doesn't fit well in ANY carseat :eek: had the twins been in an accident before they hit 7-8 lbs or so, they woulda been toast.

Here in KS it's enforceable too. They can pull you over and ticket you for kids not being in a carseat, without having any other reason (such as speeding, etc)

There are car seats (the kind where the kid isn't in a sitting position but a lying(sp?) position for the premies. Not as safe as a car seat but much better for them because then the mass of their big old noggin doesn't block their airway during the drive home.
