this is pissing me off. help
ok
help me out here i sold my moms car in january... about a month ago i get a letter in the mail that we got a ticket because of not showing our registration on the car we sold. so i called the dmv they said they recieved our notice of release of reliability and the new owner went in MAY to register the car , they paid the fees but they were suppose to also smog it and come back to like pick up the regustration, but according to the dmv they never smogged it. so they basically paid the reg fee but no smog. therefor the car has not completley transffered. i sent a letter to the parking citation place, and i get a mail today saying the request was not accepted because the car has not been fully transfered CVC 5602. this is really pissing me off !!! what should i do ! |

If memory serves, under California law, you were required to smog it before you sold it. Thus, its your failure.

If you smog the car and send in the release, you are covered whether they correctly register the car or not. Since you did not smog the car, you're in the dreaded gray area. Did you keep a copy of the transfer form? Either way, your going to have to spend some serious time on hold on the phone or at the DMV to find out EXACTLY what you need to do to completely remove any liability on your part. You may have to talk to multiple people until you get a good answer.
I know that's not what you want to hear, but only the DMV can release you from the liability. |

The seller is supposed to smog it.
Should have gotten AAA. They pretty much handle all of the transfer papers for you and tell you exactly what to do. Mine experience selling my sister's car was relatively painless. |
