Sigh... How can we make these stupid lawsuits stop? Disclaimers on everything? Never serve hot or cold foods? Constitutional amendment? Oy...

Fixing some laws to protect a business without giving them too much protection that they are shielded from wrongdoing Basically the system that is in place just says that each case will be decided by the courts and our faith is in the judge/jury to make the correct decision if whatever the business is accused of doing was wrong or not.

We have a system in place and most people that do win what people think would be "frivolous lawsuits" won because of some other neglect that it was felt the company was actually wrong in doing.

Even the Mcdonalds Hot Coffee case had a bit of merit when you find out that the coffee they were keeping on hand was hotter than it needed to be to be "Hot Coffee" when you got it. And she only really won about 200k not over 1 million.

But anyways, I think that the system in place probably works atleast 90-95% of the time, if not more.

A Person sueing is different than a person winning a frivolous case.

Very true. Only 1 minor point:

Coffee should ideally be 196 to 204 degrees F (some round to 195 to 205 degrees F) for optimum taste. Macdonalds kept their coffee at a lower 180-190 degrees F. The lawsuit called for 135-140 degrees F as more consumer friendly.

It'll be a sad day when all our food will come with a 12 page full-color instruction booklet and waiver of stupidity.

Great, now because of her greed we are going to get stuck with hot poppers that aren't hot anymore. I mean have you guys tasted McDonald's lukewarm coffee recently?
