SSS: I got screwed by an ebayer UPDATE
I didn't stop fighting with paypal over this and was on the phone with them again today for almost an hour. Finally got to a supervisor who told me he would put in my claim for review. I do a few more things and then go to check email and there is mail from them. I expected to see the usual, Sorry but..... . They gave me the money back. They actually deposited the money in my account and I immediately transfered it out.
I feel like I fought city hall and won. I hope I didn't post this here before but I'm still mad enough that I have to vent. First I will accept some of the responsibility because I was 1 day late in filing a dispute. There was a listing on ebay for a speaker I want that was BIN or OBO. I made an offer that was accepted and was sent an invoice that I promptly paid. After a reasonable amount of time and getting the runaround from the seller, no speaker or refund I contacted paypal. They say they sent me an email stating that I had to upgrade my dispute to a claim. I never got that email and because I didn't respond they say I have no right to take any action. This seller has screwed 6 people out of their money that I have found on the sellers feedback on ebay. So, I'm out $355 because I tried to save $150. OK, I feel better now.

how long did you wait to file with PayPal... They give you 45 days.
When you contacted PayPal, you didn't file a dispute? What did you do? Did you just talk to a rep? Just wondering... I've had to dispute about 3 PayPal charges over the past 8 years, and pretty much I didn't lose any money on any of them. ============================== EDIT... Oops.. now I see that you did file a dispute but you didn't file the claim within 20 days (per PayPal policy)... Aww.. that sucks. Did you pay with a credit card? I always do... I'd contact the CC at this point if you did. Force them to acknowledge your claim.

I ALWAYS use a credit card because I don't trust PayPal to have my best interests and like you discovered, sometimes their claim timeframe is a little too tight. (No doubt your seller was hoping this exact same scenario would happen.)
When you pay with a CC, you can have them reverse the charges. I GUARANTEE you'll be contacted in short order by a PayPal rep to discuss the reversal.

I did file a dispute and they say they sent me an email that I needed to escalate it to a claim within 20 days. I never got that email.
This is the first time I've run into a problem with an ebayer or paypal so again I have to accept part of the blame. I now know too that I will always use a CC to fund paypal. I'm contacting all the other people this seller has screwed to see if all have files a claim. Paypal told me that if there are enough claims against a seller they will 'revisit' my claim. Otherwise I'm just SOL. |
