Please help - ebay fraud

I bought a cell phone on e-bay listed as "New and Sealed." It arrived opened, scratched and (I called the sprintPCS) activated!

I spoke to the seller and he was full of sh$&%, said it was never activated and was shipped brand new.

I told him to credit my paypal account for the cost of the phone and shipping (that is how I paid), and I would pay the return shipping charge out of my own pocket, and if he did this i would not leave any feedback.

He told me to send the phone back first (yeah -- right!)

What is the eaiest way for me to get some of my money back. Luckily the total cost was $130.

Should I go to paypal, amazon, both?

How was this guy's previous feedback?

Anyway, do as he says. Send the phone back. If he doesn't give you back your money, then you dispute the charge w/ your CC company.

You should be able to do this since the item was not delivered.

I would then follow up with paypal and ebay and of course, leave bad feedback on the guys account.

SnotRocket, I guess you missed that I mentioned I used PayPal. If I paid with visa or mc i wouldn't have a problem -- i'd just return the phone to the seller with return receipt.

In this case I can't just send it back. He'd most likely 1) not credit my paypal, 2) find another sucker.

Interesting idea, but the guy wants to see the phone to make sure it is the same one that he sent. Yikes! Any other ideas would be appreciated.

Aye there's the rub. I send you phone back and get no money. I wait for paypal credit and keep the phone. Or I send phone back and get paypal credit back. It's like watching that game show Friend or Foe. Both friends everyone wins. One foe and he doubles his winnings. Both foes and no one gets anything.

Yeah check his ratings and see if he's "trustworthy" to return your paypal.

I'll post what happens. This is the last e-mail that I sent to the guy:

Hi JD,

I got your message yesterday. I already got a new
phone, so please credit my paypal for $127.50.

The phone has been activated, is worn, and is in
"fair" condition. It is clear that someone has gotten
alot of use out of it. I was interested in buying a
new, sealed, unactivated phone. I have every right to
receive my money back.

I have 100% positive feedback from e-bay, because I am
an honest person. I am accurate when I specify the
condition of the items that I sell.

When you credit my account I promise to send you back
the phone within 24 hours, not counting Sunday. I
will also pay for the postage out of my own pocket.

I'll be happy to get rid of the phone that you sent
me. Even if you let me keep it, what would I do with
it? There is next to no value in a well used Samsung
<omitted from post>. The case is also worn out and has no value.

A copy of this e-mail is being sent to the the e-bay
fraud investigation.

I hope that you do the right thing.

What feedback does the seller have? If it's a new account, I'd think twice before sending anything back. You may wish to notify eBay if you haven't already done so.

If he wants the phone back and you want your money back, use a third-party, non-affiliated escrow service. They do charge a premium to use the service, but it's an assured way to get your money back while allowing him to get the phone back.
