S: More Ebay/PayPal Madness...

Man... I guess I've really gotten myself into a mess here.

On 9/1/04, I won an auction on Ebay for an Audio Control Line Driver unit to put into the HEMI... http://cgi.ebay.com/ws/eBayISAPI.dll...e=STRK:MEWA:IT

Well when I win Ebay auctions, I nomally like to take care of the payment part rather quickly so that I can get my stuff... so I made a payment to PayPal for the amount due.

Well, then I waited... and waited... and waited for the item to arrive. 2 weeks pass and still no item so I send the following e-mail

I've never used it to find that as I have always done business with people who were more than happy to respond via e-mail with all the details of the shipment. I just checked on PayPal and went to the FAQ page...

"How do I obtain Shipment Tracking information from my seller?" and it says....
"We encourage you to contact your seller directly to obtain the Shipment Tracking information."

It does not give any additional info about getting the tracking information through PayPal. Here is a link to that information in case you are wondering where I got that from:

I have looked all over my "Transaction Details" and nowhere do I see that any "shipping information" has been posted.... therefore I don't see this tracking information that you say should have been posted there.

Now you say that my payment was received on Friday before labor day.... well I MADE that payment on September 1st which is the Wednesday before labor day and I have the PayPal ID to prove it. And even if the shipment was made on say Wednesday September 8th at the slowest possible service (assuming 5 day shipment service), I should have seen it sometime around the 14th or 15th... however my ORIGINAL request was only asking for the tracking number, assuming that it was in transit... and not necessarily whether or not it was "delivered". However I could not get ahold of you which led to some frustration and the message I sent below.

Either way... right now, I need you to check on this shipment again and provide the correct tracking number. Please do so as soon as you can. I'd really appreciate it.

So I'm like WTF? I gave him a PayPal Transaction ID to reference my payment, yet he says that he hasn't gotten paid!!! What gives?

And on top of that, he wants ME to contact PAYPAL to find out what is going on... Of course I'm like, that should be HIS responsibility. I have a receipt here...

So I fire off the following e-mail...

As I am writing this, I am going ahead and calling PayPal right now.... we are going to get to the bottom of this. One way or another.

Please review the document that I have attached... I'll let you know what PayPal says when I get ahold of a customer service representative.

Now I thought I was doing him a favor by calling PayPal to get a clarification on this... but then he sent me this nasty note:

Honestly, I never saw any apology from you about this situation (even though you did apologize for sending the wrong tracking info)... especially if you have gotten that confirmation e-mail from PayPal explaining and confirming this situation, which I'd hope that you'll have either tonight or maybe tomorrow. I asked them to CC me on that message, however they stated that since they would have some of your personal information on that message that they couldn't give me a copy of what they were sending you, however they assured me that it would be sent.

As far as you not getting paid.... my thing is... I gave you the transaction ID# and the visual proof of the payment. At that point you very well could have called PayPal and confirmed everything that I have told you instead of getting all defensive towards me. At this point you have lost NOTHING, you still have the item in your possession however I only have a credit balance sitting on my credit card so for the amount of the transaction and I am out of $60 until this gets resolved with no unit in hand. Now granted... I understand that you believed that you hadn't been paid, but if I can give you a Transaction number AND a "Confirmed Payment" reciept, then why couldn't you just have taken that info and found out why it didn't show up in your PayPal seller account instead of asking me to do all of the legwork for you? Did you think that my print screen was forged? If so... then one call from you to them would have verified that as well and we could have avoided this unpleasant business and your response back to me could have just stated "It's all cleared up and your unit will be on the first shipment out tomorrow morning... sorry about the mix-up" and it would be a done deal, everybody's happy at that point... but no, it didn't go down like that.

So you don't like my attitude.... well I didn't really take kindly to what I saw as a "hands off" response from you as the seller. Pretty much you gave me the impression that this wasn't your problem... and that was wrong in my opinion (now do you want to apologize for that?). And now YOU feel like the victim here. Needless to say this could be solved rather quickly.... but as far as apologies... well that may be owed on both sides, especially beginning with why you didn't respond to my initial 2 e-mails... that you didn't respond to. You were too busy trying to tell me off that my math was wrong in counting the weeks from when the auction closed versus the item being shipped and then you sent me a bogus tracking number.

Honestly dude... this really started smelling like a scam to me at that point, and I have an itchy trigger finger to just cancel the whole deal and get back the money that PayPal has already taken from my account, which since this money didn't come out of your funds, I guess wouldn't affect you... right? Personally, this is just a SNAFU... and we have to figure out where we go from here.

Just let me know... do you still want to do business or what? I honestly, don't want to deal with an angry seller (since now you are not happy with what I have said) who will send me a product that could potentially have problems and what not due to lack of care in "customer service relations". Now I'm not implying that you are that kind of seller... but the thought does cross the mind. If do not want to continue this transaction, then I'll initiate the buyer dispute process and just forget the whole thing.

I do understand where you were coming from with not seeing the payment, but I did think that you at least owed me more interest and duty in following up on all of this mess in trying to rectify the situation instead of just pointing the finger back at me. However, maybe you just don't care as I'm just another nameless, faceless person in the crowd buying stuff on an online auction or something.... /shrug. I dunno.. Either way, I don't want to feel uncomfortable doing business with someone and I don't want them to feel uncomfortable with me. Things can be worked out, but it takes cooperation with both parties. If you'd like, you can call me at 317-XXX-XXXX or if you give me your phone number, I can call you and we can resolve this personally, if you feel that would be better.

Either way... please read the e-mail that is coming to you from PayPal. If you still feel angry about my words above... then just let me know and I'll be done with it per PayPal's resolution mechanisms. It's your call at this point. Hopefully we can reach a mutual agreement on this situation.

I've always had good relationships with all the people I have bought from and I have 100% feedback approval rating, but this guy really has my dander up now.

I don't understand why he left you positive feedback on 11 Sep, yet he's claiming you haven't paid him...sounds like he's definitely got his wires crossed on his end. He's definitely in the wrong with regard to his sarcastic tone and slow communication.

Look on the bright side, if you get the item, you can always leave him negative feedback without having to worry about retaliation, since he already left his...

This cat does seem a little stupid or shaky. Along with the negative feedback, there are also a number of neutrals (not a ringing endorsement). Is it possible he has multiple PP a/cs and is just confused?

Do a look-up of his name/address to get a phone number and give the guy a call. You've documented your positions via email, now it's time to get to the bottom of things.

Yeah... I realized that, however my thing was... I have been trying to get in touch with this guy for like a week now... and until I threatened him, he never responded.

So now he's saying that I'm being unreasonable.... yet he still hasn't even once tried to contact PayPal to try to resolve this. Talk about being "unreasonable"...

Well he finally talks to PayPal and sends this followup email...

So even in the face of the facts, he STILL want's to make this "my fault"... I'm tellin you, this guy is a true card.

Pretty much he still never truly apologizes for the hassle that he has put me through. So I send him the following reply:

Now back to the business at hand... Are you willing to show me a sign of goodwill here and rush ship the item to me at no additional cost to me? I've acknowledged that you have told me that my $60 was not going to make or break you, therefore I would consider it a great show of goodwill on your part if you could do that for me. On my end, because I was expecting to have the unit by now, I had an installer on standby waiting for that unit so that he could incorporate it with other components of my stereo that I had purchased (and had already received) and we were waiting on this unit as the sole hold out so that we could begin the install process this weekend (which is not going to happen now due to this not being resolved until now).

Also, I am going to be out of town in the middle of next week and throughout the next weekend, therefore slower methods of shipping would bring this item to my residence and no one would be here to receive it (hence a new dilemma). Finally, waiting beyond next weekend is out of the question since that would be too close to the 30 day PayPal time limit to resolve any potential issues that might still arise in this transaction (i.e. product damaged in shipment, Dead on Arrival, etc...)

So if it is acceptable to you to have this item shipped 2nd day or faster at no additional charge to me... then please ship it out to me first thing in the morning. This would mean that I'd at least get it guaranteed delivered by Monday (or Tuesday at the latest) of next week... which would be acceptable to me. If these terms are not acceptable to you, then I'll have to settle for a full refund of the PayPal charges.

Please let me know which option you prefer... and thank you for your efforts in this matter.

I don't know about anyone else, but if I got $60 that didn't match up to any of my auctions, I'd probably look a bit closer at it. I don't usually assume that people are just going to send me $60 for no reason

When, for example, an individual in a circumstance like this one says something to the effect of, "I am an honest person." That statement not only asserts the way the person is describing themselves but, at the same time, the statement insinuates that the other person is not. I understand that was not necessarily the intention but that is the effect.

There are several times, approximately beginning with the third email where examples of this instance can be seen.

I do, however, see how both sides were under the impression they were right. One of the things he said does stand out-If you paid for an item online and went to the store to pick it up but the store did not show that you paid for it, would they let you take it home anyway?-(something to that effect) Obviously the answer is no. But, ultimately you DID actualy pay for it and he HAS had your money for quite some time now and he HAD NOT shipped the item. Ultimately it was found that he was in the wrong. This appears though to be due to ignorance and not by a willful intent.

At this point I would suggest calling him, I see you are comfortable emailing, at the number he provided. Matter-of-factly discuss the issue and what you'd like done. If he is not agreeable to your 'bottom line' arrangement cancel the deal. If you can get all of your money back through ebay-great, if not dispute the amount with your credit card. This falls under a "billing error" for items/services paid for but not provided/ not as advertised.

I hope to see the final outcome.

So far... he hasn't responded to the last e-mail I sent....

That means either

A) he's done talking about this and is ignoring me... thus the deal is off and I'll have to go through PayPal to get my money back... or

B) he "mysteriously left town" again and didn't read my e-mail... and doesn't know that I have given him my "final settlement" on this (He'll probably use this excuse... if I press him on it) or

C) He has shipped the item, yet not notified me of that (highly unlikely)

More or less, I am giving him the benefit of the doubt until Tuesday... if it doesn't show up then, then I will just cancel the whole thing and get my money back. Honestly, I ain't worried about getting the money back because it is on my credit card and I have proof that it was never shipped.

On top of that... I kinda get the impression that he never really wanted to send it in the first place... maybe he thinks he can get more for it if he puts it back up for auction or something. Either way, he is defiinitely in the wrong here since his negligence caused this. The funny thing is... an auction I won a WEEK after that one got delivered to my door that same day... and I used my PayPal account to pay for it. They obviously didn't have any problems figuring out that I had paid for the product.

Honestly, this guy is a pure Idiot and *******... and I'm 'bout ready to be done with dealing with him.

Now what I gotta figure out is how to give him the most scathing NEGATIVE feedback in 80 characters or less. You guys got any suggestions for that? Kinda hard being very descriptive of the problem within 80 characters.

I thought about that, but in Ebay the feeback removal rules state:

*Feedback left by a member who bid on or purchased an item solely to have the opportunity to leave negative feedback for the seller, with no intention of completing the transaction.

its been dead since he gave u the wrong tracking #. lotta effort (more than $60 worth) on your part, meet with increasingly difficult and deceptive behavior on his = no deal. the email exhange with your completely opposite ebay philosophies detail by detail makes for high unintentional comedy though. the only way it could be funnier is if this guy turned out to be frank stallone. thanks for that.

Well this is officially dead now...

I just filed the PayPal buyer dispute... Here's what I said:

This auction was completed on 9/1/04...after not receiving the item or word about the shipping details, I e-mailed the seller on 9/9 and 9/11 and got no response, I e-mailed again on 9/13 and finally got a response. Seller said item had shipped and provided a UPS tracking number. This was the wrong number for a different customer shipment. I e-mailed again informing this, and the seller responded that I had not paid him for the item and would not ship the item until PayPal had paid him. I gave him the Transaction ID# of this transaction as proof that he had been paid and the seller denied this saying that PayPal had not credited his account. We went back and forth on this. I asked the seller to call PayPal himself to find out what was going on but the seller refused still claiming that he had not been paid. So I called PayPal myself and spoke to "Larry". I explained the situation to Larry and confirmed the payment. I e-mailed the seller again, yet he still claimed he hadn't been paid even though proof says he was. More back and forth e-mails and he finally calls PayPal himself and finds out that he is in error and that I did in fact pay him (he didn't recognize my corporate account name of DFDesignz). Now 3 weeks have passed and I asked the seller to rush ship this item to me at no additional charge to me as a show of goodwill. Seller did not respond to this request and as of today this item still has not been shipped to me. Seller ultimately made the mistake with this transaction yet does not own up to it, nor make good on it. The 30 day time limit for any recourse on this item is soon approaching and I didn't want to be left holding the bag if the item didn't live up to expected standards. More or less, this seller rather argue with me than try to work with me in resolving the situation. He put the burden of proof into my hands and didn't accept responsibility for his actions. Therefore I must cancel the transaction and request a full refund.

Pretty much you get 2000 characters to type a message, and I used 1996.

I did use all 2000 of them but I went back and edited some stuff before sending and ended up at 1996.

Now we get to see what they say about it....

Pretty much once this is cleared... next step NEGATIVE FEEDBACK! I still need to think about what I want to say...

Yeah... I'm on it.

I got 90 days to do that... now, I'm just gonna try to get my money back.

Credit card company should be getting a call shortly from me.

He's definitely in the wrong with regard to his sarcastic tone and slow communication. Look on the bright side, if you get the item, you can always leave him negative feedback without having to worry about retaliation, since he already left his... __________________

That statement not only asserts the way the person is describing themselves but, at the same time, the statement insinuates that the other person is not. I understand that was not necessarily the intention but that is the effect. There are several times, approximately beginning with the third email where examples of this instance can be seen. I do, however, see how both sides were under the impression they were right. One of the things he said does stand out-If you paid for an item online and went to the store to pick it up but the store did not show that you paid for it, would they let you take it home anyway?-(something to that effect) Obviously the answer is no. But, ultimately you DID actualy pay for it and he HAS had your money for quite some time now and he HAD NOT shipped the item. Ultimately it was found that he was in the wrong. This appears though to be due to ignorance and not by a willful intent. At this point I would suggest calling him, I see you are comfortable emailing, at the number he provided. Along with the negative feedback, there are also a number of neutrals (not a ringing endorsement). Is it possible he has multiple PP a/cs and is just confused? Do a look-up of his name/address to get a phone number and give the guy a call. You've documented your positions via email, now it's time to get to the bottom of things. Good luck.

That means either A) he's done talking about this and is ignoring me... thus the deal is off and I'll have to go through PayPal to get my money back... or B) he "mysteriously left town" again and didn't read my e-mail... and doesn't know that I have given him my "final settlement" on this (He'll probably use this excuse... if I press him on it) or C) He has shipped the item, yet not notified me of that (highly unlikely) More or less, I am giving him the benefit of the doubt until Tuesday... if it doesn't show up then, then I will just cancel the whole thing and get my money back. Honestly, I ain't worried about getting the money back because it is on my credit card and I have proof that it was never shipped. On top of that... I kinda get the impression that he never really wanted to send it in the first place... maybe he thinks he can get more for it if he puts it back up for auction or something. Either way, he is defiinitely in the wrong here since his negligence caused this. The funny thing is... an auction I won a WEEK after that one got delivered to my door that same day... and I used my PayPal account to pay for it. They obviously didn't have any problems figuring out that I had paid for the product. Honestly, this guy is a pure Idiot and *******... and I'm 'bout ready to be done with dealing with him. Now what I gotta figure out is how to give him the most scathing NEGATIVE feedback in 80 characters or less. You guys got any suggestions for that? Kinda hard being very descriptive of the problem within 80 characters.
