SS: Yet another company full of ****

WARNING: 75% rant ahead!

Frankly, I'm getting ****ing sick and tired of the piss poor quality of service from companies that want my money. If you want my money, I want a level of service that I find acceptable. It's hard enough to find a company any more that makes me happy, now I am hoping to find companies that at least keep me in the field of neutral.

I bought a necklace for the girlfriend from this company: http://www.phoenixdesignjewellery.com/

The necklace:


In total, $237 shipped. Not bad for an all silver necklace. I ordered it on October 2nd of 2005. In the past month and a half I have been going back and forth in e-mails with this asshat asking about updates. He says it's sent but not sent with any form of tracking. I say okay.

At the beginning of November, I start e-mailing him again asking where it is. He says it was sent (but can't give me a specific day) and I should have gotten it. Low and behold, no necklace. After a few more e-mails, it was all too easy for him to say, "I'll just send you another one if it isn't there by tomorrow."

I respond with, "Okay, I will pay any extra costs for shipping this replacement with a tracking number." His response was that he would cover those costs.

Two weeks later, I still don't have a mother ****ing tracking number and when I e-mailed him on Friday, he says he'll give me a tracking number on Tuesday (today). Still no tracking number and I try to file a dispute through PayPal.

Sorry, your purchase is over 45 days, we can't help you. We encourage you to contact the seller.

WHAT THE ****?!

Updates later as they arise, I am on hold with PayPal now.

Big part of the reason that I only buy through trusted sellers online. (i.e. Somewhere big, like Amazon, or somewhere that has a B&M store) And I never pay through paypal if I can help it.

how frustrating.
the "no form of tracking" when he first supposedly sent the necklace out would've made me nervous from the start.

i guess you really have reinforced the fact that we should all just buy from trusted retailers.

PayPal pretty much told me they can't do anything.

They've e-mailed the seller but that's all they are going to do and it won't be followed up. It's just a mark against his account and if it becomes frequent with future buyers, then his account will be looked at. Other than that, I am on my own.

I..really...can't...say...how...pissed...off...I...am.

Trust me, they investigate everything. Their office is right across the street from me and i've been there hundreds of times. Good people working there, genuinely concerned with helping those who have been ripped off.

if you used a cc you could have your cc chargeback paypal to reclaim your money.

Update: The sender still refuses to get me a tracking number. Just keeps replying with, "I told you already, it's sent." As if I should trust him on this.

Bank of America has refunded my money and is sending me out legal documents to sign and send back with the e-mails as evidence.

PayPal still refuses to help...although when Bank of America gets involved I am sure they will.

Necklace still hasn't arrived.

As my girlfriend says, now that Bank of America is involved, we can just send an e-mail to this guy saying, "That's right, you got owned by the Bank of Motherf***ing AMERICA!" (this is for humor)

have you ever bought anything from a UK site or any other country for that matter? i haven't ventured.

Update: Necklace arrived today, it was sent out six days ago after I had made it clear I wasn't screwing around and I was contacting PayPal / Bank of America.

PayPal fully denied the appeal on the case review stating that I was on my own to get either a refund or the item.

I closed the open appeal with Bank of America. Bank of America was the only one who seemed willing to help, and they did refund my money when I first initiated the comlpaint. I just had to pay it back to them when I closed the case.

I'll get a real life picture of the necklace tonight.

Also, F Paypal. Same thing happened with them over an internet purchase of mine 4 years ago - they wouldn't do anything, so I turned to my CC provider, MBNA. Hell yah. MBNA / Visa laid the smack down on Paypal.

Of course my Paypal account was frozen (but I had no $$ in it anyways), but hey, I wanted my $650 back.

Glad you got your necklace from the vendor.

You're probably the only person from whom I've heard that. Even BofA employees I've know hate how they screw everyone. But of course that's on the banking side, you're probably talking about their CC service. Which I do have right now because they took over two companies of which I have accounts with, so far they seem ok.

We too have been 'had' by this individual. IE ordered goods, and had either delays, promises etc. We are in the UK

It may interest you to know that we have have contacted trading standards, and they have asked us to write to him via recorded delivery mail demanding a refund in full by a given date. If he fails to comply, then Trading Standards can commence action for recovery.

For your interest the telephone number quoted on the website is FRENCH not a UK number.
There is a French website quoting his address in France (we have sent the same letter there).

Here is his mobile number 07967907491. The French address is Phoenix Design, 15 chemin de Trauquetard, Boissel, 81600 Gaillac, France.

Please keep us updated with your situation as if Trading Standards have to take action they will be interestered in other people who have been affected.

You maybe interested to know that there is a recorded messae on the original telephone number for Phoenix Deisgn 01737 7880548. I have checked the mobile number but there is no reply at present just an answering service, the same as the French number.
My order was placed a few days after yours and has followed excatly the same pattern.
