Copywrite question...

Is ity against the law to rip mp3 from a band playing a live set on pay per view? I'm not talking about audio and video, just audio. Its not like they sell the music ever again after the pay per view is over. Just wondering.

I would assume so, unless the band gave all listeners permission to use their music. ...and tell me if I'm wrong, but isn't music copied from a source without permission technically "legal" for 24 hours? I think I read/heard that somewhere.

Wouldn't that just be considered a bootleg? I think that bootlegs are technically illegal, but generally nobody cares. Some bands even encourage them.

If you record the broadcast for your own personal use, I believe that would fall under the "fair use" clause of the copyright act.

I know you can video tape the PPV, and watch it over and over to your heart's content. I don't see why that wouldn't apply to the audio tracks.

If you were to distribute the MP3s (or the video tape), that would be a violation of copyright law.

Oh, and I think that "24-hour" rule is an urban legend.

That's pretty much the way I understand the law. You are allowed to record things broadcast into your home for your own personal use. Afterall, it is why we have VCRs.

Remember that all of the cable companies and movies studios did try to take the manufacturers of the first VCRs to court for milions of dollars and intending to shut down the manufacturers...but they lost. I imagine that you're pretty safe because of this legal precedent.

i am so sick of reading stupid record industry propaganda about the dire effects of piracy

their whole thing about the "dangers" of bootlegs and how they hurt artisits.....so unbelieveably stupid. what is the biggest touring band of all time? the greatful dead! and what did the greatful dead do? they made a ****ing soundboard available so that people could get high-quality copies of their shows! did that hurt them? apparently not. did it help them? i think a strong case could be made that it did.

is the connection too ****ing complex for the ignorant ass clowns at the RIAA to understand? give stuff to your fans, and the fans will give money back to you! be a d!ck, and you're going to loose in the long run.

I'm with you whitak24.

I think it's easier for the bloody RIAA to blame piracy than to blame the economy or their horrible business model. After all, it's a case where you fit the evidence according to what you want to say.

I probably should have mentioned that I didn't endorse it or anything, but if by some chance you DID get busted, that's the arguments their lawyers would use.
