    protecting your home question

    So i think in new york if you shoot someone while they are in your house and you feel threatened is considered self defense.

    What about stabbing someone... repeatedly?

    Lets say someone sneaks into your house and you sneak up on them and cut their throat.. or you know like stab them through the heart.. that's more aggrivated, anyone knows how that works? Gug maybe you got an answer

    I don't know how NY laws work. I'd imagine that you'd have to prove you still felt your life was in danger after you'd already stabbed the guy seven times.

    In New York-you can defend your home, family and self anyway you can-as long as the intruder is completely INSIDE your home..(and if he's not-drag him in before you slit his throat)..it's self defense..you can bash in someone's head with a golf club as long as they are in your home without your consent and it's perfectly legal. .

    I think stabbing someone repeatedly can show that you were trying to kill them...not really self defense. I mean, it all kind of depends on how the prosecuting lawyer wants to use it.

    They can kind of use it to show that the person had no self control and continued to stab and kill the victim (robber), instead of just stabbing him once to "scare him off" or immobilize him.

    What the hell did you do?

    The first 2 or 3 cuts... and you may go free... in self defense

    Stab the guy like 31 times... and you'll be up on manslaughter charges.

    You try that and you'll be in big trouble. You can't just kill someone unless they are threatening you. They have to come at you or reach for something. If you sneak up from behind and do him it is murder. It is not self defense unless they are actually threatening you.

    Check with a lawyer, not us. The issue is that different states have different standards and conditions. Florida did everyone there a favor by removing a condition of self-defense whereby it was illegal to kill someone attacking you if you retreat. So consider situations like that.

    I think you could get out of this with the "movie defense". In every movie, just when you think the "killer" is dead, he gets up and attacks you again. You were just making sure that he didnt do that with 31 stabs.

    i asked a KSP person about this a while back and he said you can use as much force as is used againts you. if they have a wepon and they are trying to use it then you can use a wepon againts them.

    Well, laws vary by state and locale, but that's a stupid interpretation and/or law. When some drug-addled ne'er-do-well breaks into my house, I'm not going to take the time to interview him and take an inventory of his possessions.

    I may do him the favor of aiming my shotgun at his kneecap instead of his chest, but I won't offer much more consideration than that.

    Yeah, it's better to kill someone than to injur them. The dead can't sue and the dead can't lie. That said, do it quick and in as few movements as possible because even I won't buy that any stab beyond 20 is in self-defense. IMO if someone breaks into my house, they are automatically a threat to my family and I hope I will do everything I can to eradicate that threat. If I go to jail, so be it.

    depends how big ur knife is... ... multiple wounds from a 1" knife doesn't sound as bad as multiple wounds from a 12" blade....
